We have created this Privacy Policy to demonstrate our firm commitment to your privacy and security. Vayama pledges to protect you with our Privacy Policy which defines our policies on the collection, use and protection of personal information of Vayama users. We encourage you to read this Privacy Policy carefully. This Privacy Policy is effective May 17, 2010 and Vayama may update this Privacy Policy from time to time. If we decide to make any material changes to this Policy we will notify you by placing a prominent notice on our website. By using our website or by submitting any personal information to us, you agree that Vayama may collect, use and disclose your personal information in accordance with this Privacy Policy and as permitted or required by law.
What kind of information we collect from you:
(a) when you are visiting our website
When you are browsing our website, you are not required to provide any personal information unless and until you make a purchase on Vayama or sign up for one of our other services.
We use a variety of technologies including session data, cookies, log files, and web beacons to better understand how our website is navigated, how many visitors click on certain pages, how long and how frequently visitors visit our website, the types of searches that occur, the browsers and computer operating systems used by our visitors and the Internet Protocol addresses from which visitors connect to our website. Information specifically about you, called "Personally identifiable information" or "PII" is not captured and retained when capturing data about our website.
Third-Party Tracking Services
We also use a number of third-party tracking service that uses cookies and web beacons to track non-personally identifiable information about visitors to our site. Information such as number of visitors, page views, referrals and site exit points are captured for us to learn more about our customers.
One of our goals in collecting this information is to help customize your user experience. We generally do not share this information with third parties, except as described in this privacy policy.
Web Beacons
We and our third-party tracking service partners employ a software technology called Web beacons that help us better manage content on our site by informing us what content is effective. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, Web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers' personally identifiable information.
We may also use Web beacon in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see 'Choice and Opt-out.'
How Vayama secures your information
All personal information you provide to Vayama is transmitted using SSL (secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt information being sent between you and our site. SSL is utilized in the Vayama site when you are purchasing travel.
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. (b) when you are purchasing products
In order to purchase travel and related services and products through our website, you must provide us with specific personal information such as your name, credit card number and expiration date, credit card billing address, telephone number, email address and the name or names of the person(s) traveling (if not you). We may also ask you for other personal information, such as your frequent traveler numbers. We need this information to process, fulfill and confirm your reservations and transactions.
If you are making a reservation for one or more travelers other than yourself, you will need to make sure that each of these other travelers agrees in advance and that you may disclose their personal information to us.
(c) when signing up for emails from Vayama
We will not share, rent or sell any email addresses provided by you to Vayama.
If you do NOT want to provide your information:
You can always choose not to provide your personal information to us; however some information about you is required in order for you to register on our website, purchase products and services, to ask us a question; or initiate other transactions on our website.
With whom we share your personal information:
We may disclose the personal information that we collected from you in any of the following situations:- if this is necessary for providing services to you;
- if we have received your permission beforehand;
- in accordance with this Privacy Policy; or
- in very special circumstances, such as when we believe that such disclosure is required by law.
To successfully fulfill and complete your booking we must provide certain personal information of yours to third parties such as airlines, hotels, car-rental agencies, or other involved third parties.
We may also share your information with third party vendors that perform services for or on our behalf. For example: to provide customer care, issue documents, process credit cards, deliver tickets, ship items, for research, marketing, data processing, to measure the use of our site, to facilitate usage by a visitor, or evaluate your creditworthiness. We will share with these companies only that personal information which they need for providing services to us and they are not permitted to share or use the information for any other purpose including their own marketing purposes. These companies might be located outside Canada. By submitting your personal data to us, you agree to the transfer, storing and processing of your data outside Canada.
Vayama currently contracts with several online partners to help manage and optimize our internet business and communications. We use the services of a third party provider to help us collect data and measure the effectiveness of our advertising and how visitors use our Website. To do this, we use web beacons and cookies provided by the third party service provider on this website. The type of information we collect includes e.g., the product codes and prices for merchandise that visitors purchase, the pages visited, etc. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kinds of offers our customers like to see. Although the third party service provider logs the information coming from our website on our behalf, we control how that data may and may not be used.
We may also share your information: (i) in response to subpoenas, court orders, or other legal process, (ii) to investigate, prevent, or take action regarding illegal or suspected illegal activities, (iii) to protect and defend our rights and safety; and (iv) to enforce our Terms, (v) in relation to a divestiture, merger, or sale of assets.

Vayama does not control any cookies or other features that third parties may use, and the information practices of these advertisers are not covered by this Privacy Policy. Please be aware that these third parties may also contact you to obtain additional information to fulfill your travel reservation.
Children's privacy:
Vayama does not sell travel or other services for purchase by children and does not knowingly collect information from people under the age of 18. If we become aware of the fact that a minor is attempting to submit personal information, we will inform the minor that he or she is ineligible to do so. We will then remove this information from our records.
This is version 1 of our privacy policy and is effective as of May 17, 2010. We may make changes to this Privacy Policy from time to time, often based on the requests from our customers. All material changes will be disclosed in future versions of our policy. Changes may apply to the information collected from the date we post the revised Privacy Policy, as well as to existing information held by us. All material changes to this policy will be made in compliance with the privacy laws. We will notify you and seek your consent if we were to use or disclose your personal information in any way other than what is legally allowed and as disclosed here.
